Cancellation of entitlement to undertake transactions

Jerusalem Holy Items may deny certain customers/users access to the website and/or the Company's services in general on each of the following grounds:

False details were deliberately given when placing the order,

Private customers may place orders without having to register through the website. Business customers shall be required to register according to the website's prevailing conditions before receiving relevant price quotes.

Products and prices

The products displayed on this website are unique, quality products. A different stock exists for each product displayed on the website and therefore we cannot guarantee that each item shown shall be available at all times. While at Jerusalem Holy Items, we make every effort in order to present the most up to date information possible concerning the products which may be ordered and their prices, and make every reasonable effort to ensure that the website shall be up to date at all times, it is important to stress that a product ordered through the website may not be in stock. It should be understood accordingly, that the display of products on the website constitutes an invitation to treat and the ordering of a product does not create a binding obligation on Jerusalem Holy Items to supply it. Should a product be ordered which is not in stock, a Jerusalem Holy Items' customer service representative shall inform the customer of this by email, and where possible, he shall be given the option of choosing replacements, if they exist, for the product that was ordered. Naturally, the customer shall not be charged for a product which was ordered but which is not in stock and/or which was not supplied to the customer for a reason connected to Jerusalem Holy Items.

In this regard, the customer and/or user of this website shall not make any complaint, demand and/or claim against Jerusalem Holy Items or anyone acting on its behalf with respect to products that were not actually supplied.

The Jerusalem Holy Items website does not undertake that the description of a product and/or other content presented on the website shall be precise, complete, reliable, up to date and/or error-free. Similarly, all the images shown on the website are intended for illustration purposes only and there may be a difference between te appearance and/or size of the product in the picture and the actual appearance and/or size of the product which the customer shall receive. We cannot guarantee that the image of the product as it appears to the customer on the computer screen, IPad, tablet, cell-phone and/or other device shall be a carbon copy of the actual product, primarily because each screen shows items in a different color depending on the device's resolution.

Unless imposed upon it by law, Jerusalem Holy Items shall not be responsible for damage of any kind which shall be directly or indirectly caused to the customer and/or to any third party as a result of the products which were purchased on this website and which were supplied to Jerusalem Holy Items by their manufacturer and/or importer.

Prices shown on the website

When placing an order you are aware that due to human error and/or a design fault and/or operational error, the price of the product as shown on this website may not be up to date and/or accurate. In such a case a Jerusalem Holy Items customer service representative shall inform the customer of the mistake and the actual price of the product. Where the product has not yet been sent to the customer, he may choose, after the update, whether he wishes to terminate the order process in the light of the change or to cancel the order. Where the order has already been sent, the customer agrees, in accordance with the terms of use of this website that Jerusalem Holy Items may charge him for the difference between the price that was paid and the actual price or he shall be obliged to return the product. Jerusalem Holy Items likewise undertakes that should there have been a price discrepancy in the customer's favor it shall credit the customer's means of payment with the amount by which he was overcharged.

The prices on this website are shown in dollars. The customer shall be charged according to the local currency purchase and sale exchange rate on the date of the purchase.

Purchase Orders

A product may be ordered through the website on any day, at any time and from any place in the world*.

Private customers - Private customers may place orders by entering the information required by the website. Upon selecting an item its price shall be displayed and it may be added to the website purchase basket, following which the customer can then go back and choose additional items. After placing his order the customer shall be transferred to check out in order to complete the purchase procedure. The prices presented on the website do not include delivery charges, which shall be paid for separately according to the sums shown at the time of placing the order and depending on the method of delivery chosen by the customer.
Provided that not more than 6 hours shall have elapsed since the time when the order was made, a request to change or cancel it may be sent to by email to sales@jerusalem-items.com, and on the same day on which the email request was received a reply shall be sent to the customer by email informing him, subject to the terms of this agreement, whether his request had been accepted or not. The product shall be dispatched within 2 business days from the day on which it was ordered.

Business customers - In order to place an order a business customer must be registered on the site and be a Jerusalem Holy Items member.. After the custom has registered and been approved as a business customer by Jerusalem Holy Items, a window shall open for the purpose of this order or a price quote according to the product and the quantity being requested.
When supplying the order to the business customer the price of delivery shall be added calculated according to weight and/or bulk and the delivery options available to business customers.

An order received from a business customer may only be changed on the same day on which it was made by forwarding a request to . After this time has passed no changes may be made to the order. Moreover, as soon as the order to a business customer has been prepared for delivery, the order may not be cancelled. The order shall be dispatched to a business customer within 3 business days from the day on which it was received.

* The order shall be delivered subject to the conditions and locations as defined in the paragraph entitled "Delivery policy and return".

Delivery and return policy

General

While Jerusalem Holy Items website shall make every effort to supply you on time with the product you have ordered, supply of the consignment is dependent upon receiving full and correct details from the customer at the time when the order was placed, the validity and receipt of payment authorization of and for the means of payment which were given and/or full payment for the order being received through any other means. We shall likewise not be responsible for a delay which is connected to the delivery policy in the state to which the product is being sent.
Jerusalem Holy Items may delay delivery and refrain from supplying the order if the price of the order and/or the delivery cost were not fully and/or properly paid.

Jerusalem Holy Items shall not be responsible in any way for a product which was sent at the customer's request to a post office box and the responsibility in such a case shall fall on the customer. Any product which at the customer's request was sent to a post office box shall be presumed to have arrived.

A customer who asked for a consignment to be left by the door where there is no answer at the place where it was delivered shall bear sole responsibility should it not be received.

Where a product is returned to us after being sent to an erroneous address given by the customer, the customer shall pay the entire potential cost of returning the product, including the costs of sending it back, the costs involved in delivering it to the amended address and the additional charges involved, such as customs duty.

The Jerusalem Holy Items website does not send consignments directly to Iran, Syria, Iraq, Lebanon, Afghanistan or Pakistan.

The customer must pay by bank transfer and/or paypal as a condition for our sending an order which comes to more than USD 120 in total from the Jerusalem Holy Items website to South America or Africa. Should the customer request to pay for such an order by credit card, the website staff will have to obtain payment clearance which Jerusalem Holy Items cannot undertake shall be forthcoming and the customer may be required to use an alternative method of payment.

Supply dates - A product ordered by a private customer shall be dispatched within 2 business days from the day on which the order was made. Upon completing the order, one of the delivery options must be selected and the delivery price and period shall be determined according to the option chosen.
A product which was ordered by a business customer shall be dispatched within 3 business days from the day on which the order was made. The delivery cost shall be calculated according to the weight and/or bulk of the order and the delivery option chosen.

Similarly, products which are the subject of a special order and/or which are being specially manufactured and/or which are of a quantity that requires special preparation on the part of Jerusalem Holy Items, shall be provided in accordance with an update which shall be sent by us to the customer.

Delivery options

Various delivery options may be found on the Jerusalem Holy Items website:

Shipping - Delivery within 3-16 weeks from the time of dispatch.

Air mail with tracking - Delivery within 2-24 days from the time of dispatch.

Express Mail Service with tracking - Delivery within 3-10 business days from the time of dispatch.

A business customer may choose to have the order sent by "drop shipping", in which case the delivery time shall be coordinated with him.

Jerusalem Holy Items has two main branches, one in Israel and the other in the Philippines. The requested product shall be sent accordingly.

It should be noted that the delivery times as defined in these terms are only estimates, and Jerusalem Holy Items shall not be responsible for delays caused by the vagaries of the postal service in the state to which the product is being sent, public holidays and/or weather conditions.
The customer shall be responsible for paying the tax and customs duty charged in each and every state and no claims shall be made against and/or responsibility imposed on Jerusalem Holy Items should a product not be released due to the policy of the state to which it was sent and/or non-payment of tax or customs duty charged on the aforementioned product.

Similarly, enquiries should be made to make sure that the product being ordered will be allowed to enter the state to which it is being sent and that no restriction exists on its entry to that state. In this matter too the customer shall be precluded from making any claims and Jerusalem Holy Items may not be held accountable for a product which was ordered but blocked from entering the state to which it was sent.

Return policy -

At Jerusalem Holy Items we take care to package the products or to send them in non-degradable stiff cardboard specially designed for consignments being sent abroad. Each product is wrapped in bubble wrap in order to withstand shocks and/or separately from other products, or in any way suitable for the product in order to ensure that it reaches the customer complete and undamaged.

A product may only be returned if damaged. Upon receiving a damaged product it should be photographed and the photo should be sent to Jerusalem Holy Items together with a detailed request by mail for authorization to return the product. The product must be sent to Jerusalem Holy Items within 2 business days of receiving authorization to return the product by airmail only, at the address appearing on the website under the "contact us" tab.

Under no circumstances may a garment or liquid product be returned.

The amount of the refund shall be the amount the customer was charged, after Jerusalem Holy Items shall have deducted its delivery and operating costs for carrying out the refund and sending the product.

The customer shall pay the delivery and operating costs, taxes etc. involved in returning a product.

The refund for the product shall be made to the customer via the same means of payment which he used to buy it, after we have received the product in its original packaging. The customer shall be liable for any customs duty charged on or any other sum payable in relation to a product that was returned. In order to avoid unnecessary charges by the tax authorities we recommend to clearly record the words "returned goods" on the package and to fill out an invoice, in so far as one shall be required.
A product which was sent but which was not collected by the customer despite the fact that he received a notice from the postal service in the place in which he resides asking him to come and collect it, and as a result the product was returned to us, dispatching it to the customer for a second time shall be dependant upon the customer paying the delivery costs involved.

The return of a product for a reason other than because it is damaged shall be examined according to the circumstances and only after receiving a detailed letter from the customer explaining the reason for the cancellation. Should the customer's reason be accepted, he shall be subject to these terms and shall send us the product sealed in its original packaging, pay for the delivery and any other sum which shall be required in this matter.

Liability

The Jerusalem Holy Items website service is available for use "as is" and therefore no complaint, demand or claim shall be made against Jerusalem Holy Items and/or anyone acting on its behalf with respect to the service being provided via the website, the nature of the service, the website's existing limitations or any other complaint concerning the unsuitability of the service and/or the products supplied to the customer and his demands.

Jerusalem Holy Items shall not bear any liability for any damage which shall be directly or indirectly sustained as a result of purchasing an item through this website or the inability to make a purchase or which shall be sustained as a result of an act and/or omission and/or negligence on the part of the customer or any third party, including purchase by a minor without the consent of his parents, purchase through a credit card without the permission of its owner, etc. Jerusalem Holy Items shall likewise not be accountable for any damage caused by a delay in supply or as a result of a product having been supplied in a damaged or spoiled state. Where the damage was attributable to gross negligence on the part of Jerusalem Holy Items its liability shall be limited to reimbursing the price of the product.

Jerusalem Holy Items shall not be responsible for damage of any kind which the customer and/or any third party may sustain as a result of a technical malfunction in hardware and/or software connected to the website or a breakdown in telephone and/or facsimile communication and/or a malfunction and/or omission and/or negligence connected to the website's Internet servers in their capacity as such. Jerusalem Holy Items shall likewise not be accountable, in connection with the website, for damage of any kind which may be sustained by a customer and/or any third party as a result of an act and/or omission which was not under its control, including, inter alia, a force majeure, such as an earthquake, security situation, extreme weather conditions, etc.

Without prejudice to any of the foregoing, Jerusalem Holy Items and/or anyone acting on its behalf shall not be liable for any amount of damage which exceeds the price of the products which were ordered and paid for by the customer.

Any use without Jerusalem Holy Items' express permission of the materials, services and products on this website shall be likely to constitute an infringement of these laws and the terms of use as defined on this website.
